These Terms of Service govern your use of westtexasprimalbites.com and purchases from West Texas Primal Bites (“West Texas Primal Bites,” “we,” “us,” or “our”). By accessing the site, creating an account, placing an order, enrolling in a subscription, or accepting delivery or pickup, you agree to these Terms, our Privacy Policy, Return & Refund Policy, Shipping Policy, and any product- or offer-specific terms shown before checkout.
1. Eligibility and account responsibility
You must be legally able to enter a binding agreement and provide accurate, current information. You are responsible for activity under your account, safeguarding login credentials, and keeping delivery, billing, contact, pet, and subscription information current. Notify us promptly of unauthorized account use.
2. Products, information, and availability
We make reasonable efforts to describe products, ingredients, weights, photographs, prices, availability, and offers accurately. Natural products may vary in color, texture, shape, odor, or appearance. Packaging and formulations supplied by third-party manufacturers may change. We may correct errors, limit quantities, substitute packaging without changing the ordered product, refuse or cancel orders, or discontinue products and offers. If we cancel a paid order before fulfillment, we will return the amount collected for the cancelled item.
3. Pet-food information is not veterinary care
Website content, feeding calculators, guides, chat responses, testimonials, traditional food-energetics material, and coaching are educational and are not veterinary diagnosis, treatment, or a substitute for care from a licensed veterinarian. No veterinarian-client-patient relationship is created. Individual dogs respond differently. We do not promise that a product will prevent, diagnose, cure, mitigate, or treat a disease or produce a particular health outcome.
Consult your veterinarian before changing a diet, especially for puppies, pregnant or nursing dogs, senior dogs, dogs taking medication, or dogs with a medical condition. Stop feeding and seek veterinary advice if a dog experiences an adverse reaction. In an emergency, contact a veterinarian or emergency clinic immediately.
4. Raw-food handling and customer responsibility
Raw animal products can contain microorganisms that may be harmful to people or animals. Keep raw pet food separate from human food; wash hands with soap and water after handling; clean and disinfect bowls, utensils, counters, and surfaces; thaw in the refrigerator, not on a counter; keep food properly frozen or refrigerated; and keep it away from children and people or animals at greater risk of foodborne illness. You are responsible for safe receipt, transport, storage, thawing, portioning, preparation, feeding, and disposal after delivery or pickup.
Do not feed a product that is unusually warm, leaking, swollen, damaged, spoiled, or has an unusual odor. Contact us within 24 hours and preserve the product and packaging as described in our Return & Refund Policy.
5. Orders, prices, and payment
Prices, discounts, taxes, shipping, delivery, pickup, and promotional terms are shown in U.S. dollars and may change before an order is placed. Your order is an offer to purchase; we may accept or decline it. Payment authorization may occur when the order is placed, and capture may occur according to Shopify and the selected payment method. You authorize us and our payment providers to charge the amounts shown at checkout.
Discounts have no cash value, may be limited by customer, household, order, channel, product, or date, and may not be combined unless stated. Suspected fraud, resale, abuse, pricing errors, or attempts to circumvent limits may result in cancellation or refusal of future orders, subject to law.
6. Final sales, Clean Bowl, and fulfillment issues
All sales are final except where required by law, where we verify a fulfillment error or delivery-condition issue, or where an approved Clean Bowl Guarantee claim applies. 7. Shipping, routes, local delivery, and pickup
You are responsible for accurate delivery information, safe access, timely receipt, and prompt transfer to appropriate cold storage. Delivery and pickup dates or windows are estimates unless we expressly confirm otherwise. Carrier conditions, weather, road closures, mechanical failures, demand, and other circumstances may cause delays or route changes. Detailed terms appear in our Shipping Policy.
8. Subscriptions and recurring charges
If you enroll in a subscription, you authorize recurring charges at the price, discount, frequency, and minimum commitment shown when you subscribe, plus applicable taxes and fulfillment charges. You are responsible for managing your account before the stated processing deadline. Skipping, pausing, changing, or cancelling a subscription does not cancel an order already processed. 9. Reviews, testimonials, and submitted content
If you submit a review, photograph, video, story, question, or other content, you represent that it is truthful, based on your experience, and that you have the right to submit it. You grant West Texas Primal Bites a nonexclusive, worldwide, royalty-free license to host, reproduce, edit for length or clarity without changing meaning, and display that content in connection with our business. We may remove content that is unlawful, misleading, private, abusive, infringing, or unrelated. Testimonials describe individual experiences and do not guarantee results.
10. Intellectual property and acceptable use
The site, brand names, logos, photographs, graphics, copy, guides, and other content are owned by or licensed to West Texas Primal Bites and protected by law. You may use the site for personal, lawful shopping and information. You may not scrape, copy, republish, reverse engineer, interfere with, introduce malicious code to, use automated systems against, or commercially exploit the site or its content without written permission.
11. Third-party services and links
Shopify, payment processors, carriers, subscription providers, analytics, chat, review, advertising, and other third parties may provide parts of the customer experience. Their services and policies may also apply. We are not responsible for a third-party site, outage, delay, content, or action outside our reasonable control.
12. Disclaimers
To the fullest extent permitted by law, the site and its content are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free access, except for warranties that cannot legally be excluded. Product warranties, if any, are limited to those expressly provided by the manufacturer or by us in writing.
13. Limitation of liability
To the fullest extent permitted by law, West Texas Primal Bites and its owner, employees, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost data, replacement purchases, veterinary expenses, or business interruption, arising from the site, products, delivery, pickup, coaching, or these Terms. To the fullest extent permitted by law, total liability for a claim will not exceed the amount you paid to West Texas Primal Bites for the product or order giving rise to that claim. Nothing here excludes liability that cannot legally be limited.
14. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless West Texas Primal Bites and its owner, employees, contractors, and service providers from third-party claims, damages, liabilities, costs, and reasonable legal fees arising from your unlawful use of the site, resale or redistribution, breach of these Terms, infringement of another person’s rights, or storage, handling, preparation, feeding, or use contrary to product instructions or our published safety guidance. This section does not apply to the extent a claim was caused by our negligence, willful misconduct, or another liability that cannot legally be shifted.
15. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Unless applicable law requires otherwise, courts located in the Texas county of our principal place of business will have exclusive jurisdiction. Before filing a claim, the parties agree to make a good-faith effort to resolve the issue by contacting the other party and allowing 30 days for a response.
16. Changes, severability, and entire agreement
We may update these Terms prospectively by posting a revised effective date. The version in effect when an order is placed governs that order. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions remain effective. These Terms and the policies incorporated here are the entire agreement concerning the site and purchases unless we agree otherwise in writing.
